I realized that everyone knows this, but she confused pro bono and contingency lawyers. Lawyers who work pro bono are working for the public good (it actually comes from pro bono publico, meaning for the public good). They take cases where people can’t afford representation, but are in a situation where they need one, like evictions, divorces, DV, and custody cases. The organization I work with has actually been doing a lot of FEMA appeals. Basically where someone would likely face an injustice if they didn’t have counsel.
Contingency lawyers take the case with no retainer and don’t charge the client for anything, including their time, court fees, experts, out of pocket expensive, etc. in exchange, they get a percent of whatever they’re awarded or any settlement. Because if this, and because they’re going to be out a lot of money if they don’t win, they only take cases that have decent damages compared to the work involved and that they have a good chance of winning.
There’s no injustice here and no lawyer is going to look at this case and think it’s winnable. The legal term for someone in Tophia’s situation is SOL. 🤣
