I am so serious I am not sure about the laws around elderly care in New Mexico but do you think they will be providing Maria with a case worker or someone who can get her into a home since. I mean since Tophia is against it could it be considered elder abuse?

Probably not. New Mexico doesn’t have enough money to have the resources for that, and they don’t care anyway.

Thats so sad. Marie is likely going to die because Tophia won't change.

Even if they did try to help her Marie would refuse to be with her tumor of a daughter

It depends the laws for a particular state but technically, the elderly can be involuntarily placed in a nursing home/assisted living facility if it’s proven in court that they’re incapacitated and unable to make sound decisions for themselves. However, it’s not an easy battle and definitely one that the state is unlikely to take on Marie’s behalf, especially if she and Tophia are against it.
