I think its a complicated situation where there are kind people within law enforcement, and they realize hes ill and they release him.

Has nothing to do with kind people. If they weren’t allowed to release him, sorta like the three strike system for example (might not apply here), they wouldn’t. A kind officer couldn’t write off the paperwork, it would be noticed immediately.
It is most likely the local laws/ordinances/whatever the fuck that allows the police to release people for petty crimes even if they do it multiple times. Courts might be too busy, prisons might be too full to accept a relatively low level criminal.
